Below is the definitive, step-by-step breakdown of how the conveyancing process works, what documents you must prepare, and how to securely transfer your funds out of the country.

Essential Documents Required for a Bulgarian Property Sale

To successfully transfer ownership, a Bulgarian Notary Public will require a specific bundle of legalized, up-to-date documentation. Gathering these early prevents the transaction from stalling.

  • Proof of Ownership (The Title Deed): Known locally as the Notarialen Akt. This is the cornerstone document establishing your legal right to sell.

  • Cadastral Plan / Property Sketch: This is a visual and technical map of your property’s boundaries registered with the Agency for Geodesy, Cartography and Cadastre. If your property was purchased before cadastre registration became mandatory, your developer may never have registered it. Tracking down and submitting official architectural blueprints can take up to 30 days.

  • Tax Assessment Certificate (Danachna Otsenka): Issued by the Local Taxes and Fees office of the relevant municipality, this certificate must be current (issued within the same calendar year as the sale). It proves there are no outstanding property tax liabilities. Crucially, it identifies all individuals holding legal title to the property (including spouses or heirs).

  • Bulstat Registration Number: The Bulstat is a tax identification number. Many international buyers who purchased properties years ago did so before Bulstat registration was strictly enforced; however, you must obtain or verify your Bulstat number before a notary can close your sale.

The Remote Conveyancing Process: Step-by-Step


Step 1: Appointing a Local Representative

Once you accept a buyer’s offer and receive an initial deposit, the formal legal transfer begins. Since you likely will not be traveling to Bulgaria, you will issue a specialized Power of Attorney (PoA) to your real estate agent or local conveyancing solicitor. This authorizes them to gather municipal documents and stand before the notary on your behalf.

Step 2: Signing and Legalizing the Paperwork Abroad

Your representative will draft three core transaction documents and email them to you. You must sign these in one of two ways:

  1. In person at your nearest Bulgarian Embassy or Consulate.

  2. In front of a local Notary Public in your home country. If you use a local Notary Public, the documents must be sent to your country’s Foreign Office to receive an Apostille stamp to be legally recognized in Bulgaria.

Once signed and stamped, the physical papers must be couriered back to your representative in Bulgaria. Note: Budget roughly €250 to €300 for municipal paperwork and out-of-pocket notary fees, independent of legal or agency representation fees.

Step 3: Clearing Municipal Dues

Step 4: The Notary Appointment and Escrow Funds

The closing meeting takes place at the office of the Bulgarian Notary Public closest to the property. The notary strictly reviews all deeds, cadastral sketches, tax documents, and Powers of Attorney. No property transaction in Bulgaria can be finalized without the explicit consent and sign-off of the notary.

Once approved, the buyer transfers the purchase funds. Under Bulgarian law, a dedicated transaction bank account must be opened under the seller’s name (or a secure solicitor escrow account) so the notary can physically verify that the funds have changed hands before signing the transfer.

Step 5: Court Registration and Releasing Your Money

After the notary signs off, the new title deed is sent to the local courts for formal registration. This court registration takes 3 to 4 business days.

As soon as the courts return the newly registered deed, your agent or solicitor presents it to the bank as proof of completion. The bank then immediately releases the sale proceeds, allowing you to transfer your funds securely out of Bulgaria into your home bank account in the UK, Ireland, or anywhere worldwide.
