1. Navigating Land Tenure: Freehold vs. Leasehold
Unlike Zanzibar, Kenya allows for both Freehold and Leasehold land ownership, though the process for each differs significantly.
Freehold Title: This is the highest form of land ownership, granting the holder absolute ownership of the land for an indefinite period. Transfers are straightforward once the necessary clearances are obtained.
Leasehold Title: Common in urban areas and government-allocated land, these are typically granted for terms of 99 years. When selling, you are transferring the unexpired term of the lease.
The Land Transfer Process: Every sale must be processed through the National Land Information Management System (Ardhisasa). Ensuring your title deed is digitized, verified, and free from encumbrances (such as bank charges or caveats) is the mandatory first step for any legal sale.
