Ownership
You warrant and agree that:
You are the legal owner of the property and have the right and authority to sell the Property, or you legally represent the legal owner of the Property and are under their instruction and have the right and authority to sell the Property.
You are over 18 years of age and are legally entitled to enter into these Terms.
Your property advert content
You confirm and warrant that the details, description, information and any images submitted for publication on EsalesInternational.com are true and accurate and contain no false statements, misrepresentations or omissions which may mislead any interested parties over the condition, location and availability of the Property or your lawful right to sell it. You agree that you are solely responsible for the content and accuracy of any advert that you post on EsalesInternational.com. You agree that you shall indemnify EsalesInternational.com in full and hold it harmless for any losses or damages howsoever arising, including claims from third parties, that may result directly or indirectly from any advertisements that you post on EsalesInternational.com . EsalesInternational.com reserves the right to suspend or terminate (at its sole discretion) the publication of your advertisement on EsalesInternational.com at it’s discretion, and is not obliged to inform you if this happens. We advertise on behalf of all vendors.
Renewal, duration and removal of your property advert
Your property advert will remain active on EsalesInternational.com until you request removal or the property has been sold.
Your contact details
You are responsible for ensuring that the contact details we have on record for you are correct and kept up-to-date at all times to ensure enquiries reach you.
Property enquiries and your obligations
You are solely responsible for:
Providing property details for us to create your listings.
Providing property photos.
Accepting or Rejecting the offers
Agreeing to the advertised price of the Property
Instructing your solicitor
If video viewings are requested you agree for us to hand over your email to speak directly with potential buyers on a video call.
External sites
If you choose an advertising option that includes advertising on external websites, your property will be advertised on these websites throughout the advertising period until sold. Partners are subject to change without notice. Any requested changes to your listing will take time to update on these external sites as we do not own these websites we depend on the teams behind each of these sites updating our listings on request. This can take time as some of these sites are in international countries and are dealing with hundreds of thousands of update requests per week. Any leads we get from these external sites are initially sent to your listing on our own website where you the client have verified all details are verified and correct before marketing via your draft listing.
Refunds
You may cancel your advert by informing EsalesInternational.com in writing or by email within 48 hours of placing the order. A full refund will be given.
After 48 hours no refunds will be given as the marketing fee will be spent to market your property on the external sites we list you on worldwide.
General
You understand that EsalesInternational.com cannot guarantee a buyer (properties for sale) as a result of submitting your property to EsalesInternational.com, nor can EsalesInternational.com guarantee inquiries or the legitimacy of inquiries. Under the data protection act, we cannot pass on contact details of inquiries unless prior written authorization is given by the person making the inquiry. EsalesInternational.com reserves the ultimate discretion as to which adverts, if any, are in violation of these terms. EsalesInternational.com reserves the right to alter these terms at any point and without notification. These Terms represent the entire agreement between EsalesInternational.com, and you, and all warranties and representations save as are expressly set out in these Terms are hereby excluded, to the extent permitted by law. These Terms shall be governed by the laws of England and Wales and the parties hereby submit to the exclusive jurisdiction of the English Courts.
Updates
We are happy to provide updates at any time on clicks and enquires please contact your dedicated representative for an update on how your global advertisements are performing. We can only provide regular updates if you contact us as we have a few thousand clients we are currently marketing for it is impossible to provide updates unless you get in contact with your representative. We will also make contact you when we have offers or viewing requests. We will also make contact if we feel your listings are not attracting enough interest and we need to amend the photos or descriptions to attract more interest in your property.
Third Party Agents
You agree upon accepting the terms and conditions and paying for your advertisement to allow us to market worldwide and pass on your property details to third-party agents, global brokers, and other interested parties who may be interested in your property and have access to our systems. Esales property limited does not sell property as we are not estate agents we create unique advertisements on our advertising portal to market for sale on behalf of vendors. Third-Party agents/lawyers and notaries who we have a professional relationship with will help you sell the property. We market and advertise for sale and pass on your buyer inquiries. These agents may also add your property to their websites and you agree to this by accepting these terms and conditions. Some international agents may bring some buyers directly to you through their own channels from our advertising and will charge the buyer a commission on the sale which will incentivize them to push your property for sale. You do not pay Esales Property Limited any commission.
UK Residential For Sale Listings
All UK clients marketing UK properties through us to the international markets will be given agent accounts where you have your own logins and will be in control of your own listings to upload your own photos, set your own pricing and amend your property descriptions. You contact your own leads. Any leads coming in from the international platforms are automatically placed in your CRM system for you to contact privately. We recommend appointing a registered estate agent in the UK to deal with your leads and viewings to vet them.
Yearly for sale reminder
Please note as you own the property it is up to you to inform us each year it is still for sale in writing by sending us a email to confirm.
